2. ACCOUNT REGISTRATION

By creating an account, you agree to be fully responsible for all activities that occur under your login credentials.

Users are required to immediately and unequivocally inform the Data Controller via the contact details indicated in this document if they believe that their personal information, such as the User account, login credentials or personal data, has been violated, unlawfully disseminated or stolen.

Account Closure: You may close your account at any time by contacting the Data Controller.

Account Suspension: We reserve the right to suspend or terminate accounts at our discretion and without prior notice if we detect inappropriate, offensive, or non-compliant activity. This does not entitle the User to any compensation.

Although presented with the highest technical accuracy, visuals are for reference only and do not imply any warranty. The characteristics of the selected Product will be specified during the purchase procedure.

Order Placement: Submitting your order implies the following:

The sending of the order by the user determines the conclusion of the contract and gives rise to the obligation on the part of the User to pay the price, taxes and any other charges and expenses, as specified on the order page. 

In the event that the purchased Product requires an action on the part of the User, such as the provision of information or personal data, specifications or special requests, the submission of the order also constitutes the obligation on the part of the User to cooperate accordingly.

Once the order has been submitted, Users will be sent a confirmation of receipt of the order.

All notifications relating to the purchase procedure described above will be sent to the email address provided by the User for this purpose.

8. PRICES

All prices include applicable taxes and fees. Shipping charges, if any, are shown before checkout.

9. PROMOTIONS AND VOUCHERS

The Owner may offer discounts or special promotions for the purchase of Products.

Such promotions or discounts are always subject to the requirements and terms and conditions set forth in the relevant section of this Website.

Promotions and offers are always granted at the sole discretion of the Owner.

Repeated or periodic promotions or discounts do not constitute any claim or right that may be enforced by Users in the future.

Depending on the case, discounts and promotions are valid for a certain period of time or while stocks last. Unless otherwise specified, the time limitations of promotions and discounts refer to the time zone of the Data Controller's headquarters, as indicated in the contact details in this document.

Good:

Promotions and discounts can be offered in the form of Vouchers. If the rules for using the vouchers are broken, the Cardholder can refuse to follow the agreement and has the right to take legal action if needed.

If there are special terms written on the voucher or its information page, those terms will always take priority over any general rules.

Unless otherwise specified, the following rules apply to the use of Vouchers: 

Each Voucher is only valid if used in the manner and for the period of time specified on the website and/or on the Voucher; 

The Voucher can only be redeemed in full at the time of purchase – partial use is not permitted;

Unless otherwise specified, single-use Vouchers can only be redeemed once per purchase and can therefore be redeemed only once even in the case of installment purchases; 

The Vouchers cannot be combined;

The Voucher must be used within the specified period of validity. After the deadline, the Voucher will be automatically cancelled. Any possibility of claiming rights, including reimbursement of the value of the Voucher, is excluded; 

The User is not entitled to any credit/refund/compensation if there is a difference between the value of the Voucher and the value redeemed;

The Voucher is intended for non-commercial use only. The reproduction, counterfeiting and marketing of the Voucher are strictly prohibited, as well as any illegal activity related to the purchase and/or use of the Voucher.

10. PAYMENT METHODS

The accepted payment methods are clearly indicated during the checkout process.

Some payment methods may be subject to additional terms or fees. Full details are available in the relevant section of this Website.

Certain payment options are processed directly by the Account Holder, who collects and stores the necessary payment data in accordance with legal requirements. For more information on how personal data is handled, please refer to the Website’s privacy policy.

Other payment methods, where applicable, are managed by independent third-party providers. In such cases, the Website does not collect any payment information (e.g., credit card details), but only receives confirmation once the transaction is successfully completed.

If a payment is unsuccessful or declined by the payment service provider, the Account Holder is under no obligation to fulfill the order. In such instances, the Account Holder reserves the right to request reimbursement for any associated costs or damages.

PayPal Recurring Payments:
If authorized, we store an Identification code linked to your PayPal for future purchases or for the payment of periodic installments of a previous purchase.

The authorization can be revoked at any time by contacting the Data Controller or by changing your personal PayPal settings.

    11. RETENTION OF TITLE

    Until payment of the full purchase price has been received by the Owner, the User does not acquire ownership of the Products ordered.

    12. DELIVERY

    Orders are shipped to the address provided. Check your package on delivery and report any visible damage immediately.

    We are not responsible for errors due to incorrect address input or issues after the package is handed to a third-party courier not affiliated with OSUN.

    If uncollected, the product may be returned and reshipped at the user's expense.

    13. RIGHT OF WITHDRAWAL

    Unless an exception applies, you may have the right to withdraw from the contract within the period specified below (usually 14 days) for any reason and without justification. You can find more information about your right of withdrawal in this section.

    Who has the right of withdrawal

    Unless one of the exceptions applies, European consumers have the legal right to cancel online purchases within a set time, for any reason and without needing to explain why.

    People who don’t meet these conditions don’t have this right.

    If the item is returned in worse condition because it was used more than necessary to check how it works or what it’s like, the buyer have to pay for the reduced value.

    Exercising the right of withdrawal

    To cancel the contract, the user must clearly inform the Data Controller of their decision to withdraw.

    They can use the standard form provided in this document, but it's also fine to use any other clear method. The important thing is that the withdrawal notice must be sent before the cancellation period ends.

    When does the withdrawal period expire?

    In the case of purchase of goods, the withdrawal period expires after 14 days from the day on which the User or a third party – appointed by him and other than the courier – takes possession of the goods.

    In the case of the purchase of several goods ordered together but delivered separately or in the case of the purchase of a single good consisting of several lots or pieces delivered separately, the withdrawal period expires after 14 days from the day on which the User or a third party – appointed by him and other than the courier – takes possession of the last of the goods, lots or pieces.

    Effects of withdrawal

    If the user cancels the order correctly, the Account Holder will refund all payments, including standard delivery costs (if paid). If the user chose a more expensive delivery option, the extra cost won’t be refunded.

    The refund will be made within 14 days of receiving the cancellation notice. Unless agreed otherwise, the refund will be sent using the same payment method the user used. There are no extra fees for the refund.

    Unless the Owner agrees to pick up the goods, the User must return them within 14 days after telling the Owner they want to cancel.

    The deadline is met if the goods are handed to the courier or authorized person before the 14 days are up. The refund may be delayed until the goods are received.

    If the goods were used more than necessary to check their condition or function, the User may have to pay for any loss in value.

    The User also has to pay for the return shipping.

    14. LEGAL WARRANTY

    Under EU law, all consumers are entitled to a 2-year legal guarantee. National laws may offer additional protection. UK consumers have the right to receive goods that are in conformity with the contract.

    15. SERVICE INTERRUPTION

    We may temporarily suspend access for maintenance or force majeure events (e.g., outages). Within the limits of the law, the Data Controller reserves the right to suspend or completely cease the activity of the Service. In the event of termination of the activity of the Service, the Owner will endeavor to ensure that Users can extract their personal data and information and will respect the Users' rights relating to the continued use of the product and/or compensation, according to the provisions of the law.

      16. RESALE OF THE SERVICE

      Users are not authorized to reproduce, duplicate, copy, sell, resell or exploit this Website or the Service in whole or in part without the prior written consent of the Owner, expressed directly or through a legitimate resale program.

      18. INTELLECTUAL PROPERTY

      All content (trademarks, logos, images) is the property of OSUN Cosmetics or its licensors and is protected by applicable laws.

      19. CHANGES TO THE TERMS

      We may update these Terms. Users will be notified. Continued use implies acceptance of the updated version. Previous versions are available upon request.

      20. GOVERNING LAW AND JURISDICTION

      If any part of these Terms is found to be invalid or unenforceable, it won’t affect the rest of the Terms, which will still apply.

      For European Users

      If any part of these Terms is invalid, the parties will try to find a valid replacement.

      If they can't agree, the invalid part will be replaced by the relevant legal rule.

      If a part of the Terms is crucial to the agreement and becomes invalid, the whole agreement might not be valid, unless the rest of the Terms would still work without it.

      Applicable Law

      These Terms are governed by the laws of the country where the Owner is based, as mentioned in the relevant section, regardless of conflicting laws.

      National Law Precedence

      If the law in your country provides better protection for consumers, that law will apply.

      Jurisdiction

      Any legal disputes will be handled in the court where the Owner is based, as mentioned in the relevant section.

      Exception for European Consumers

      This foregoing doesn’t apply to users who are European Consumers or consumers in the UK, Switzerland, Norway, or Iceland.
